Contract
This agreement is made, and hereby entered
into, on this __________ day of ______________, ___________ by
and between Alyeska German Shepherds,
(hereafter referred to as “ Seller “), and
__________________________________, (hereafter
referred to as “ Buyer “), for the purpose of setting forth the terms and
conditions of the purchase by the Buyer of a purebred German Shepherd from the
litter whelped on
______________________ out of:

1) The Seller agrees to sell and
the Buyer agrees to buy one ____male _____female, German Shepherd Dog,
(hereinafter “animal”) from the above-described litter. This animal is and shall be named "____________________ VOM ALYESKA". This is a legal name only, and the animal may be called whatever the Buyer wishes, but if this legal AKC registration name is changed by the Buyer, this contract is null and void except for the sections of this contract pertaining to Seller's rights and such parts protecting the animal's welfare.
2) The Seller warrants that the
above-described animal is in good health and free of communicable diseases at
the time Buyer assumes ownership. Buyer agrees to have animal examined by a
licensed Veterinarian within 72 hours, (not including weekends or holidays), of
receipt of animal. Proof of inspection will be required if this contract is to remain valid. if such proof is not provided, this contract is null and void except for the sections of this contract pertaining to Seller's rights and such parts protecting the animal's welfare.
3) The Buyer is completely
satisfied and waives any and all claims regarding the animal’s conformation and
outward appearance. (Thus meaning that the animal is of the German Shepherd Dog
breed standard set forth by the WUSV/FCI at this age.) Seller warrants that the dog's ears will stand, the dog will have a
standard coat and, with male dogs, warrants that the animal will have two
testicles descended by the age of 6 months, unless such disqualifying factor is
expressly waived by Buyer in a separate
writing.
4) The Buyer agrees that any and
all transportation costs present and future, to and/or from Sellers premises,
will be at the cost and sole responsibility of the Buyer.
5) The Buyer agrees to maintain
preventative health care of the animal including, but not limited to:
inoculations, internal as well as external parasites, heartworm preventative
medication and regular veterinary checkups.
6) The Buyer agrees to maintain
preventative care of the animal in regards to overall health and will take particular care to avoid diseases and injuries to joints and growing bones by giving careful regard to proper
nutrition, proper exercise, and preventing stress injuries, (i.e. not allowing
the animal to jump heights taller than
itself at the shoulder, no forced exercise such as running, until at least 18
months of age.)
7) Ownership of the animal shall
be transferred to the Buyer for the sale price of $___________ . Only after the total sum of the purchase price is
paid may the animal be removed from the Seller's premises. If the balance is
left unpaid by said delivery or shipping date, this agreement shall be canceled
at the Seller’s option and the Buyer shall thereafter forfeit the security
deposit in the amount of ____________ . If, in the event an animal from the
described litter is not accepted by or not available for the Buyer, the
security deposit will be held by the Seller and applied toward the purchase of
a animal from the next available litter. If the animal from the next available litter is refused by the Buyer for a reason other than the replacement pup not satisfying the 72 hour veterinary checkup, Seller's obligation to replace the original animal will then expire. If the animal in question is sold with a police, law enforcement or military discount, it is understood that this dog is being sold at discounted price to encourage and facilitate its professional utilization as a working animal. This discount is not given to encourage inexpensive or under-priced acquisition of breeding animals, and thus limited registration will be kept on any animal purchased with such a discount. This limited registration is placed on the animal with the intent that said animal can have a long working career unhindered by the strains of breeding and to further encourage this animal's working utility for the full length of its working career.
8) This puppy is being represented and sold as an animal that will be registerable by Buyer, or will be already registered by Seller, with the American Kennel Club. The Buyer agrees that this animal will not be spayed or neutered until the age of 2 years if the animal is to be de-sexed at all, which Seller finds invasive and unnecessary for the responsible dog owner, unless the animal needs such surgery to control illness or disease. Seller also will not warrant health on any dog de-sexed before 2 years of age due to the potential for growth problems and other problems associated with early de-sexing of dogs.
9) Buyer agrees that this
animal will not be used for breeding purposes until it is at least 24 months of
age to another German Shepherd, (which must meet all enumerated criteria as
well), either registered with the AKC or other certified dog registry, (SV,
CKC, USA), and ONLY after it has passed the following and has proof thereof:
OFA certification for both hips and elbows
Current negative brucellosis report from Veterinarian
Heart and Thyroid tested as normal
All inoculations and worming up to date
SchH1 or higher Schutzhund title OR equivalent certified, actively-working K9 status: (certified and working SAR dog, certified and working Narcotics detection dog, certified and working Explosives detection dog or certified and working Police
K9, etc). Breeder may also give full credit to other sport titles in place of Schutzhund titles, such as various equivalent ring sport titles, etc., upon mutual and written agreement between Breeder/Seller and Buyer.

10) The animal will be replaced
by a healthy animal from the next available, unreserved litter if diagnosed
with hip dysplasia or elbow dysplasia before and until 2 months afer the dog's second birthday. This diagnosis must be accompanied by statements from a Veterinarian who
specializes in this type of Veterinary practice and a neutral veterinarian.
These statements must be accompanied by a written evaluation by the Orthopedic
Foundation for Animals (OFA). Return of the dysplastic dog shall be at the
Buyer's discretion, but should the Buyer wish to return the dysplastic animal,
the Buyer shall incur the shipping cost to return said animal to the Breeder.
Return of the dysplastic animal is not required for replacement of said animal,
however, proof of spaying or neutering of any dysplastic animal must be supplied before replacemcent will be given. Copies of the dog's X-rays must be made for and sent to Seller. The animal's welfare is agreed to be the most important issue if the animal is
diagnosed with dysplasia. This dog must
be kept lean at all times during its life for its well-being. Veterinary health checkups clearly stating a LEAN
pup weight will be required by Seller if the hip OFA warranty is to be valid. If maintenance of proper weight cannot be
proven by veterinary statements, every 6 months, until the dog is 2 years of
age, then the hip guarantee will be null and void. It is understood by Buyer that environment plays a large part in
maintaining hip health in his or her rapidly growing pup. Quality dog food must be fed and the dog should be kept from
explosive growth due to overfeeding or nutritionally unbalanced dog foods.
11)
The animal will be replaced by a healthy animal from the next available, unreserved litter if diagnosed with any life
threatening congenital defect before one year of age. This diagnosis must be
accompanied by statements from two neutral Veterinarians. Return of the defective animal is not required for replacement of said animal,
however, proof of spaying or neutering of any dog with a congenital and life threatening defect must be supplied before replacemcent will be given. This health guarantee
in no way covers or includes buyer dissatisfaction with the temperament of an
animal. Temperament is a product of
many things, not simply genetics, and Seller accepts that much of a puppy's or
dog's final temperament or eventual adjustment is determined by the skill and
patience of the puppy's owner and how the dog is raised or integrated into the
new home/situation. Seller in no way warrants
that this dog or pup will meet any specific training objective or achievement
standard as desired or expected by Buyer.
Goals are great things to have, but one cannot warrant luck, the future,
training skill and the myriad other
things which must be in place to achieve most goals. The accomplishments of a
pup or dog are largely the result of training and the relationship between
Owner and dog. These are not things
Seller can control, and therefore are not things Seller will warrant.
12)
The Buyer agrees that should it become
necessary to sell or otherwise place this animal, the Buyer will notify the
Seller before taking such action so that the animal may, at the Seller’s
option, be re-purchased by the Seller at the original purchase price
minus a restocking fee of 40% of the original purchase price. Upon
notification, the Seller shall have 14 working days to exercise said
re-purchase option. Notice to Seller regarding the sale of the dog must be
given in writing to Seller in order to give the Seller time to decide on the
repurchase option. This clause must be exercised in the event the Buyer can no
longer care for the animal.
NOTE: Legal action will result
if said animal is placed in an Animal Shelter or Rescue without first notifying
the Seller.
13)
The Buyer agrees that the Seller may repossess the
animal upon evidence of neglect and / or abuse at no expense to the Seller, and
no refund of any monies.
14)
The Buyer agrees that the animal will NOT be left
alone in a backyard or kennel all the time. The Buyer agrees that the animal will
reside at the home of the Buyer, and have access to and opportunity for daily
exercise, socialization and play. It is understood this animal will not be chained or “ tied out “,
(see section 12), unless in the context of a temporary tie out, supervised or for training purposes. A German Shepherd Dog is not a Husky, and chaining them in this way can cause many severe behavioral problems. In addition, being left in a yard all day, with no training and socialization, also leads to dogs with behavioral problems. This animal is sold with
the EXPLICIT understanding that it is to go to a select home, to be socialized properly,
and become a member of the family, with both indoor and outdoor time provided for.
Buyer also agrees to contact Seller before using any type of shock collar on
this animal. Use of shock collars as a primary
training device shall be considered abuse by this Seller. While electric
collars can have some specific uses, this Seller regards their use as a primary and
customary training tool as misuse of this type of collar.
This agreement is made and
signed by both parties to insure the well-being and protection of this animal.
If any part of this agreement is breached, the Seller is released from any and
all further obligations hereunder.
